1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and The Accessory Consultant ("Company", "we", "us") governing your access to and use of our website at www.theaccessoryconsultant.com and our jewelry manufacturing services.

By visiting our website or placing an order, you confirm that you are at least 18 years of age, have the legal authority to enter into these Terms, and agree to comply with them in full.

2. Our Services

The Accessory Consultant provides custom jewelry manufacturing services including but not limited to design consultation, CAD modelling, sample production, and bulk manufacturing across a range of materials including solid gold, gold-filled, gold vermeil, sterling silver, and stainless steel.

All services are subject to separate written agreements, purchase orders, or proforma invoices as applicable. These Terms govern your use of our website and any communications prior to a formal contract.

3. Quotations and Orders

• All quotations provided via our website contact form or email are estimates only and are valid for 30 days from the date of issue.
• Orders are confirmed only upon receipt of a signed purchase order or written acceptance and the agreed deposit payment.
• Minimum order quantities (MOQ) apply to all product categories and are communicated at the time of quotation.
• We reserve the right to decline any order at our discretion.

4. Pricing and Payment

• All prices are quoted in USD unless otherwise agreed in writing. Indian clients are invoiced in INR.
• A non-refundable deposit of 30–50% (as specified in the quotation) is required before production commences.
• The remaining balance is due prior to shipment or as otherwise agreed in writing.
• Prices are subject to change based on fluctuations in gold, silver, or stone commodity markets. We will notify you of any significant changes before confirming your order.
• Late payments may incur interest at 2% per month on outstanding balances.

5. Design and Intellectual Property

• When you submit design files or concepts, you confirm you have the rights to use and share those designs and that they do not infringe any third-party intellectual property.
• CAD files and design work created by our team specifically for your order remain the property of The Accessory Consultant unless a separate design buyout is agreed and paid for in writing.
• We retain the right to display finished products in our portfolio or on our website unless you request confidentiality in writing prior to placing your order.

6. Samples and Approvals

• Bulk production will only commence after the client has approved a physical sample in writing (email confirmation is acceptable).
• Sample charges apply and are communicated at the time of quotation. Sample costs may be deducted from the bulk order value at our discretion.
• The Company is not liable for variations between the sample and bulk production that fall within industry-standard tolerances (±5% in dimensions and ±2% in weight).

7. Delivery and Shipping

• Production timelines are estimates and may vary due to material availability, customs, or force majeure events. We will communicate any delays promptly.
• All goods are shipped Ex-Works (EXW) Mumbai unless otherwise agreed. Risk passes to the buyer upon handover to the carrier.
• The client is responsible for all import duties, taxes, and customs clearance in their country.
• We recommend all shipments be insured. We are not liable for loss or damage during transit.

8. Quality and Returns

• All products are quality-checked before dispatch. Claims for defective goods must be raised within 7 days of receipt with photographic evidence.
• Accepted defect claims will be resolved via replacement, rework, or credit note at our sole discretion.
• We do not accept returns for products manufactured to client specifications that meet quality standards, or for orders where the client approved the sample.

9. Limitation of Liability

To the maximum extent permitted by applicable law, The Accessory Consultant shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our website or services. Our total liability for any claim shall not exceed the value of the specific order to which the claim relates.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra. For international clients, we are willing to consider arbitration under UNCITRAL rules as an alternative dispute resolution mechanism.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Continued use of our website or services after changes constitutes acceptance of the revised Terms.
